These Terms of Service govern purchases made through Topfakeid.com (the “Company,” “we,” “us,” or “our”). By placing an order through the website, you (“Customer,” “you,” or “your”) acknowledge that you have read, understood, and agreed to these Terms of Service.

Our products are offered solely as customized novelty, entertainment, creative, collector, costume, prop, and display items. We operate our business on the basis that these products are intended for lawful purposes only.

We do not sell identification documents for use in illegal activities, fraud, deception, age verification, identity verification, or any other unlawful purpose.

By completing an order, you agree to use the product only for its stated novelty purpose and in accordance with applicable laws and regulations.

1. Nature and Intended Purpose of Our Products

Products sold through Topfakeid.com are customized novelty items.

They are intended for legitimate purposes such as:

Costumes and cosplay;
Theater and stage productions;
Film and video productions;
Photography and creative projects;
Private events and themed parties;
Collecting and display;
Props and entertainment;
Artistic and educational projects; and
Novelty gifts and personal keepsakes.

Our customized products are not government-issued identification documents and are not intended to function as official credentials.

A novelty product purchased from Topfakeid.com must not be represented as an authentic driver’s license, state identification card, passport, government credential, or other official identification document.

The Company does not represent that any novelty product has legal identification value.

2. Prohibited Uses

Topfakeid.com does not authorize or permit customers to use our products for unlawful purposes.

Customers expressly agree that they will not use, present, distribute, modify, or otherwise employ a novelty product purchased from the Company:

To commit or facilitate fraud;
To misrepresent identity;
To misrepresent age;
To obtain access to age-restricted goods, services, venues, or establishments;
To obtain financial services or financial accounts;
To obtain employment through false identification;
To establish false residency;
To obtain government benefits or services through false information;
To travel or pass through security using the product as official identification;
To evade law enforcement or other lawful identification requirements;
To impersonate another person;
To deceive a business, government agency, organization, or individual;
To violate applicable federal, state, provincial, local, or other laws;
To infringe the intellectual property or privacy rights of another person or organization; or
For any other unlawful or fraudulent purpose.

The Company reserves the right to refuse, cancel, or decline an order where we reasonably believe the requested product or its intended use may violate these Terms or applicable law.

3. Customer Agreement

By placing an order, the Customer confirms that:

The Customer is legally permitted to purchase the product in their jurisdiction;
The Customer understands that the product is a novelty item and not official identification;
The Customer intends to use the product only for lawful novelty, recreational, creative, collecting, entertainment, or display purposes;
The Customer will not represent the product as genuine government-issued identification;
The Customer will not use the product to establish identity, age, residency, employment eligibility, driving privileges, or access to restricted services;
The Customer will comply with all applicable laws and regulations;
The Customer will not use the product to facilitate fraud, deception, impersonation, or any other unlawful activity; and
The Customer will comply with any applicable venue, event, production, or organizational rules concerning novelty identification-style props.

Checking the “I have read and agree to the Terms of Service” option during checkout constitutes the Customer’s electronic acceptance of these Terms.

4. Customization Information

Our products are customized using information supplied by the Customer during the ordering process.

The Customer is responsible for ensuring that the information supplied for customization is accurate, appropriate for the requested novelty product, and does not contain information that the Customer is prohibited from providing.

Customers should provide only information that is necessary for the requested novelty design.

The Company may decline customization requests containing information that we reasonably believe could facilitate unlawful activity, fraud, impersonation, deception, or infringement of another person’s rights.

We may also refuse an order where the requested design, wording, image, or customization creates a reasonable concern regarding unlawful use.

The Customer is responsible for reviewing submitted information before completing an order.

Where a mistake results directly from incorrect information supplied by the Customer, the Company may not be responsible for producing a replacement at no additional charge.

5. Photographs and Other Customer-Supplied Materials

Where a product requires a photograph or other customer-supplied material, the Customer confirms that they have the right to provide that material for the requested novelty purpose.

The Customer should not submit photographs, personal information, government documents, or other materials belonging to another person without appropriate authorization.

The Company may reject submitted materials that appear unlawful, misleading, abusive, infringing, or inconsistent with the intended novelty purpose of the product.

Customer-supplied materials will be handled in accordance with our Privacy Policy and applicable privacy requirements.

6. Order Review and Acceptance

Submitting an order does not necessarily require the Company to accept that order.

We reserve the right to review orders before production and may cancel or decline an order when:

The requested product appears inconsistent with its stated novelty purpose;
The requested customization appears intended for unlawful use;
The request could facilitate fraud, impersonation, or deception;
The submitted information is incomplete or unsuitable;
The requested design infringes another person’s rights;
The order presents a legal or compliance concern; or
We otherwise reasonably determine that fulfilling the order would be inappropriate.

If an order is cancelled before production, any applicable refund will be handled according to our Refund Policy.

7. No Official Identification Status

Customers expressly acknowledge that products purchased through Topfakeid.com are novelty products.

A novelty product does not replace:

A driver’s license;
A state identification card;
A passport;
A government-issued identification document;
An immigration document;
An employment authorization document; or
Any other official credential.

The Company does not issue government identification and is not affiliated with, authorized by, endorsed by, or acting on behalf of any government identification authority unless expressly stated otherwise.

Customers should use official identification whenever an individual, business, organization, government agency, transportation provider, financial institution, employer, venue, or other authority requires valid identification.

8. Refund and Replacement Policy

Customized products are produced according to the specifications submitted by the Customer.

Because customization may begin after an order is submitted, cancellation and refund eligibility may depend on whether production has started.

If a product arrives defective or materially different from the approved order because of an error attributable to the Company, the Customer should contact us within 24 hours of delivery and provide photographs or other reasonable evidence of the issue.

Where a verified manufacturing or production error exists, the Company may, at its discretion, provide a replacement or other appropriate remedy.

Issues caused by incorrect information, spelling errors, incomplete information, or materials supplied incorrectly by the Customer may not qualify for a complimentary replacement.

Nothing in this section is intended to exclude consumer rights that cannot legally be excluded or limited under applicable law.

9. Shipping and Delivery

Orders are shipped using the available shipping method selected or provided during checkout.

Estimated shipping and delivery times are estimates and are not guaranteed unless expressly stated otherwise.

Once an order has been transferred to the shipping carrier, delays caused by the carrier, weather, customs, transportation interruptions, incorrect delivery information, or circumstances outside the Company’s reasonable control may affect delivery times.

Customers are responsible for providing complete and accurate shipping information.

Where tracking information is available, it may be provided through the applicable shipping service.

10. Compliance With Applicable Laws

The Company is committed to operating its business lawfully.

We do not knowingly sell products for illegal purposes and do not authorize customers to use our products in violation of applicable law.

Because laws concerning identification-style novelty products may differ between jurisdictions and circumstances, customers are responsible for understanding the rules applicable to their particular location and intended use.

The fact that a product is described as a novelty item does not authorize a customer to use it unlawfully.

If a particular jurisdiction, venue, organization, or activity prohibits identification-style novelty products, customers must comply with that prohibition.

Nothing in these Terms should be interpreted as legal advice or as a representation that a particular use is lawful in every jurisdiction.

11. Intellectual Property and Personal Rights

Customers must not request customization that infringes another person’s copyright, trademark, publicity rights, privacy rights, or other intellectual property or personal rights.

The Company may refuse designs that appear to unlawfully reproduce protected materials or impersonate another person, business, organization, or authority.

Where applicable, the Customer represents that they have the necessary rights or permission to submit materials used in a customized design.

12. Product Changes

The Company may make reasonable changes to product designs, materials, manufacturing processes, layouts, or available customization options from time to time.

Where a change materially affects an existing paid order, the Company will make reasonable efforts to address the issue with the Customer.

Product photographs shown on the website may be illustrative, and minor differences in color, placement, finish, or appearance may occur depending on manufacturing and display conditions.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, products are provided for their stated novelty and recreational purposes.

The Company does not represent that a novelty product is suitable for any purpose other than the purposes expressly described on the applicable product page.

The Company makes no representation that a novelty product will be accepted as identification by any business, organization, venue, government agency, transportation provider, financial institution, employer, or other third party.

No novelty product sold through the website should be relied upon as official identification.

Nothing in these Terms limits any consumer warranty or statutory right that cannot legally be excluded under applicable law.

14. Limitation of Liability

To the maximum extent permitted by applicable law, the Company will not be responsible for losses arising from a Customer’s unlawful, unauthorized, or prohibited use of a novelty product.

The Company is likewise not responsible for a Customer’s decision to represent a novelty product as official identification or to use it for a purpose prohibited by these Terms.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Where liability may legally be limited, the Company’s liability will be limited to the remedies available under applicable law and, where permitted, to the amount paid by the Customer for the specific product giving rise to the claim.

15. Indemnification

To the extent permitted by applicable law, the Customer agrees to indemnify and hold harmless the Company and its officers, directors, employees, contractors, and representatives from claims, losses, damages, liabilities, costs, and reasonable expenses arising from:

The Customer’s violation of these Terms;
The Customer’s unlawful use of a novelty product;
The Customer’s misuse of a product contrary to its stated purpose;
The Customer’s infringement of another person’s rights; or
Information or materials supplied by the Customer that cause a third-party claim.

This provision does not apply to the extent that the underlying claim results from the Company’s own unlawful conduct or liability that cannot legally be transferred to the Customer.

16. Privacy

Information submitted through the website is handled according to the Company’s Privacy Policy.

Customers should review the Privacy Policy before submitting personal information or placing an order.

By using the website, the Customer acknowledges that information may be collected and processed as described in the Privacy Policy and as permitted by applicable law.

17. Changes to These Terms

Nothing in these Terms is intended to deprive a consumer of mandatory rights or protections available under the law of their jurisdiction.

Any dispute should first be brought to the Company’s attention so that the parties have a reasonable opportunity to resolve the matter informally.

20. Entire Agreement

These Terms of Service, together with the applicable Order Information, Privacy Policy, Refund Policy, and other policies expressly incorporated into these Terms, constitute the agreement between the Customer and the Company concerning purchases made through the website.

These Terms replace prior statements or understandings concerning the same subject matter, except where a separate written agreement expressly provides otherwise.

21. Customer Confirmation

By completing an order through Topfakeid.com, the Customer confirms that they understand:

Our products are customized novelty items intended only for lawful purposes.

We do not sell identification documents for illegal use.

Our products are not government-issued identification and must never be represented or used as such.

The Customer is responsible for using the purchased product only in accordance with these Terms and all applicable laws.

If the Customer does not agree with these Terms, they should not place an order through the website.
